Customers are granted license to use the Virtual Tours for 6 months from the date created. Customers may display tours, and pictures on the local MLS, Realtor.com or on personal websites. You may grant your local MLS use of your license, however we do reserve our copyright of the produced images.

All copyright of panoramic and associated images which constitute a Virtual Tour or Photo Presentation will reside with ElectroTours.com. ElectroTours.com will always hold all rights to the idea, to the intellectual property, to the techniques employed to produce the Virtual Tour, and any other technical information. ElectroTours.com reserves the right to use any panoramic or digital images for promotional reasons in the press, in print publications, or on the world wide web, without prior permission by the customer. ElectroTours.com requires that on every photograph and page of the Virtual Tour that a Link & Picture watermark be present which links to one of our company web sites. These policies assure that ElectroTours.com receives credit for the photography and assures the customers that pay for our service that no other companies or real estate agents are able to use these photos.  Photography is our business and these policies are to help assure that we can remain in business and provide our customers with this service. The link and or watermark are to remain on every photograph and page of the Virtual Tour and under no circumstances is it to be removed or altered in any way. Failure to conform to this requirement will result in the customer being liable for any financial losses incurred by the breach of this requirement. When you order a service from ElectroTours, what you are really paying for is a license to use the material. ElectroTours is issuing a license for your use only. It is illegal for you or anyone else to use, copy, sell, or distribute in any manner, this material without the express written permission of ElectroTours. You cannot sell or give another agent this tour for them to use. They must contact ElectroTours directly. ElectroTours are non transferable. 

All copyright for still photos will remain with ElectroTours.com. The customer may use the finished images in what ever manner they like providing that the intended use is not inappropriate, offensive or insulting. Where photos are to be published on the world wide web, in the press, or in other publications, then credit must be given to the photographer (ElectroTours.com) where appropriate. If the watermark needs to be removed for publishing please send us an email and we will respond as soon as possible.

All and any pictures or images that a client / customer sends or gives to ElectroTours.com either by email or in real property will become the property of ElectroTours.com. By sending or giving pictures to ElectroTours.com  client / customer is giving ElectroTours.com all rights and or copyrights to the pictures / images.

By sending any pictures of images to ElectroTours.com you are agreeing and stating that you have all necessary permissions to use the image and that you own the copyright to the images.

ElectroTours.com reserves the right to reference and link to the finished (Virtual Tour or pictures) web site for any promotional reasons.

All images and media are the sole property of ElectroTours.com. We reserve all rights to these images, media and content. All images and media are made available to client until the tour hosting time has expired. Tours will be hosted on our servers for 6 months or until the property is sold or the listing is no longer active which ever comes first. At that time ElectroTours.com will delete the tour from our servers with no prior notice.

You have selected the services of ElectroTours.com. We believe our service is the #1 virtual tour marketing program in Tampa Bay. Photography is our business and
ElectroTours.com reserves the right to seek compensation for any financial losses incurred due to any breach by the customer of the above stated rights.

 

INTELLECTUAL PROPERTY INFRINGEMENT AND COPYRIGHT CLAIMS
It is the policy of ElectroTours.com to respond expeditiously to claims of intellectual property infringement and copyright claims. ElectroTours.com will promptly process and investigate notices of alleged infringement and will take appropriate actions under the Digital Millennium Copyright Act ("DMCA") and other applicable intellectual property laws.   ElectroTours.com will make its best efforts to provide quality, and uninterrupted hosting services for your "Visual Open House" virtual tour or photo presentation however, this is not a guarantee. ElectroTours.com will not be responsible for any damages caused by service interruption, outages or temporary delays.
 

MLS & Linking your tour
ElectroTours.com will make available a link to each "ElectroTour ™" hosted including photos and a link to the MLS friendly versions of the ElectroTour ™. It will be the customers responsibility to have the photos and link added to any websites or MLS systems. ElectroTours.com will help in anyway with this process. However, we can not guarantee your MLS or website will accept the photos or the link. Please check with your local MLS administrator for their terms of service policies.

ElectroTours.com:  except in cases of extreme negligence claims no responsibility for the photographer’s selection of shots and photos. Please advise the photographer of any special photos you would like included in your tour.

Once your “ElectroTour ™” is finished, it will be uploaded to the ElectroTours.com website. The URL to the tour will be sent to the email address we have on file for our customer. This URL can be used to create a link from your own personal or company websites.

ElectroTours.com will process each shot taken per the package guidelines unless we deem it to the agent’s or homeowner’s best interest to not show a particular shot. This can be the result of poor lighting, bad weather, or unclean cluttered rooms or scenes.


 
An ElectroTours.com photographer will photograph the home as-is. The photographer will not be responsible to move objects, straighten or dust objects, open or shut windows or doors, etc. The photographer will, however, turn lighting on or off and open or shut blinds if it results in better images.

We only post virtual tour links, we are not responsible for getting still shots onto MLS or other websites.

Posting to realtor.com
ElectroTours.com has the ability to post directly to Realtor.com (for a small fee) In order to post the ElectroTour ™, the listing needs to be on the Realtor.com website and we must have the necessary information to post the tour (MLS number, etc.) Once we post the tour to Realtor.com,
We are not responsible for the reliability of their services.

If your listing has expired and you have not extended it, or it is withdrawn for whatever reason, REALTOR.COM automatically deletes the link. To re-post the Virtual Tour to REALTOR.COM, there will be an additional posting fee of $24.95. Realtor.com charges that fee. This is not something we have control of.
 

Tour Posting
A “Visual Open House - ElectroTour ™” will be posted online only after receiving the required information as outlined at the time of the appointment. From the time of the photo shoot it can take 48 to 72 business hours to post the tour online. The information we need includes but is not limited to an asking price, an address, square footage, the number of bedrooms and bathrooms or anything else deemed important. ElectroTours.com will do minimal research to get the required information. We may take the information from a local MLS database, or other online resources that use MLS information such as your company website. We will assume unless told otherwise that you have the right to post such information and have the copyright to such. ElectroTours.com will not be and is not responsible for any delays that are the result of missing information.  If ElectroTours.com receives any disputes over the copyright information provided to produce your tour we will remove it at once and contact you right away.
 

ElectroTours.com is not automated with the local MLS. It is the customers responsibility to post the tour on the agent’s MLS. This is usually a simple process. We strive to provide detailed instructions for linking tours to MLS sites. If you need help linking your tour, please contact ElectroTours.com or your local MLS tech support.


All Copyright, images and media are the sole property of ElectroTours.com. We reserve all rights to these images, media and content. All images and media are made available to client until the tour hosting time has expired.

Live Help Policy   Top

ElectroTours.com Uses the Live Help service provided by Crafty Syntax Live Help

This service is provided as is and free of charge. We do not guarantee a live customer service person will be available. When time permits we will have the service activated and help viewers with tour questions. Any viewer contacting us from a MLS friendly tour will not be given any listing information or agent contact information. We will only provide help viewing the tour.

Below is a copy of the Terms of Service associated with this service. By using this service you accept these Terms of Use and agree to be legally bound by all of the terms and conditions of this Agreement.

We may automatically amend this Agreement at any time.

  1. We may terminate this Agreement or service immediately for any reason.
  2. Due to the existing legal and technical environment of the Internet, we cannot ensure that all of your private communications and other personally identifiable information will not be unexpectedly disclosed. By way of example (without limiting the foregoing), we may be forced to disclose your private communications to the government or third parties under certain circumstances, or third parties may unlawfully intercept or access transmissions or private communications. Further, we can (and you authorize us to) disclose any information about you or private communications by you to law enforcement or other government officials, as we, in our sole discretion, believe necessary or appropriate.
  3. WE PROVIDE YOUR ACCOUNT AND OUR SERVICES "AS IS." OUR SUPPLIERS AND WE EXPRESSLY DISCLAIM ALL WARRANTIES OR CONDITIONS OF ANY KIND, EXPRESS, IMPLIED OR STATUTORY, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF TITLE, NO INFRINGEMENT, MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. You understand that our services may be unavailable for extended periods of time, and we do not warrant or ensure the continuous availability of our services. Some states do not allow the disclaimer of implied warranties, so the foregoing disclaimer may not apply to you.
  4. IN NO EVENT SHALL OUR SUPPLIERS OR WE BE LIABLE FOR ANY LOST PROFITS OR SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES (HOWEVER ARISING, INCLUDING NEGLIGENCE) ARISING OUT OF OR IN CONNECTION WITH YOUR ACCOUNT OR THIS AGREEMENT. OUR LIABILITY TO YOU OR ANY THIRD PARTIES IS LIMITED TO $50. Some states do not allow the foregoing limitations of liability, so they may not apply to you.
  5. The services hereunder are offered by Bravestorm, LLC located in Wichita, KS. This Agreement is governed in all respects by the laws of the State of Kansas. Both parties submit to personal jurisdiction in State of Kansas and further agree that any cause of action relating to this Agreement shall be brought in a court in Wichita, KS. If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced. Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches. We shall not be liable for any delay or failure to perform resulting directly or indirectly from any causes beyond our control. You consent to us sending you emails, as we deem necessary. This Agreement sets forth the entire understanding and agreement between us with respect to the subject matter hereof.

Cancellation and Appointment Policy   Top
 

Client must cancel by calling ElectroTours (727-493-4817) 24 hours in advance. (Leave a Message)
No email cancellations will be accepted.

The following will result in a cancellation fee of $25.00
1. Agent or homeowner not present to let photographer in the property. (Unless arranged by lockbox in advance)
2. The home must be clean and presentable at the scheduled time of the appointment.
3. The client must provide the valid address of the property. 
4. Any cancellations due to weather will result in a cancellation or travel fee (Unless tour is rescheduled)
 It will be the agents responsibility to cancel for anything weather related.

Once the photographer has arrived at the property only to find out it has been cancelled the client will be charged the full price of the tour.

Syndication / Linking

Our syndication list is subject to change without notice. ElectroTours does not represent that all of these companies will display our tours at any given time. Some of the companies listed have term limits and expiration times on listings submitted. These times are determined by the listed companies and can range from 30 days to 6 months. ElectroTours are exposed through multiple channels, which in its totality comprises of  The ElectroPath Network


 

Payments and Refunds   Top

Payments: Due to the nature of our business. Payment is expected prior to or at the time of service unless arrangements have been made in advance.
Please contact us if you would like to set up a house account for billing.

Payments need to be in the form of a Credit Card. *No checks after 10-1-07

Refunds: Due to the nature of our business we do not offer refunds in any form. ElectroTours.com is a service based business. After the service and man hours have been completed we are not in a position to refund any payments for any reasons. However it is our practice to completely satisfy each customers concerns. We may at our option issue credits to customers on future tours or photos when deemed appropriate.

Disputes: All disputes must be handled by our customer service department. No disputes will release you from the obligation of paying the amount due per your invoice during the dispute time in question.

Invoices: We are an internet based company.
All invoices will be sent only by email to the email address you submit at the time of order.
No paper invoices will be sent. You may request a paper copy of your invoice by calling our customer service department.

Collections and Late Fees

Governing Law:

These Terms and Conditions shall be governed by the laws of Florida and Pasco County Florida,
 without regard to the choice of law or conflict of law rules thereof.

We are a service based business.
If you are late on your payment you will be charged the following late fees.
Your invoice includes the late fee schedule listed below.
You will be responsible for adding your late fees prior to sending your payment.

10 days late from the date on the invoice $10
20 days late from the date on the invoice $20
30 days late from the date on the invoice $30

After 30 Days All ElectroTours on your account will be marked past due online
until your account  is paid in full.

After 30 Days your broker and the home owners will be invoiced.

In the state of Florida, realtors and agents are representatives of their broker.
All listings are the sole property of the broker.
Agents and Brokers are also representatives of the home owners.
If you order a virtual tour for your client and do not pay the invoice we will bill and proceed to collect funds from the listing broker (the owner of the listing) and the home owner.

After 60 days we will file a small claims suit against the agent that ordered the service.
All suits will be filed in our home county (Pasco)
At this time you will be assessed all late fees, court cost and filing fees.

Disputes: All disputes must be handled by our customer service department. No disputes will release you from the obligation of paying the amount due per your invoice during the dispute time in question.

Invoices: We are an internet based company. Your credit card statement will act as your receipt.
All invoices will be sent only by email to the email address you submit at the time of order by request only.
No paper invoices will be sent. You may request a paper copy of your invoice by calling our customer service department.

ElectroTours.com recognizes the importance of protecting the privacy of personal information about our customers. Personal information includes all of the personally identifying information that is provided to ElectroTours.com

ElectroTours.com
is sensitive to these privacy interests and believes that protecting valuable personal/financial information is one of our most significant responsibilities.

The policies outlined below describe ElectroTours.com policies to protect your privacy.

Use, Collection and Retention of Client Information
ElectroTours.com collects, retains and uses only the information about our customers that is required by law to administer the business and provide high-level services to our clients. We retain this information no longer than necessary to meet these objectives.

Maintenance of Accurate Information
ElectroTours.com has established procedures so that a client's financial information is accurate, current and complete in accordance with reasonable commercial standards. Any request to correct inaccurate information is responded to within a timely manner.

Limiting Employee Access to Information
All ElectroTours.com representatives are educated about the importance of privacy and confidentiality. Only those representatives having a business reason for knowing such information have access to personally identifiable information.

Protection of Information via Established Security Procedures
Its ElectroTours.com maintains rigorous security standards and procedures regarding unauthorized access to customer information.

Maintaining Customer Privacy in Business Relationships with Third Parties
If it is necessary to provide personally identifiable customer information to a third party, ElectroTours.com shall insist that the third party adhere to similar privacy principles that provides for keeping such information confidential.

Disclosure of Privacy Principles to Customers
ElectroTours.com customers have the right to know what information we keep about them and how the information is used. Customers have the right to have any inaccurate information corrected or deleted.

W-9, 1099's & Receipts

ElectroTours will only provide each client with an Invoice for tax purposes. The paid invoice can be used as your receipt for tax purposes and deductions. All that is required by law is for ElectroTours to provide you with a receipt that includes our company name, address and contact information and amount paid. We do not supply W-9 forms for our clients.

Any customer that must require a W-9 will be assessed an administration fee of $25.00.

All payments must be made out to the company. "ElectroTours"

You will still be required to pay your invoice on time for services provided regardless of W-9 issues.

ElectroTours is in no way to be considered your companies sub contractors, employee or agent. We are a serviced based business just like an automotive shop, beauty salon, auto body shop etc. Please use your invoice receipt for any and all tax issues.

Expiration Date

ElectroTours are hosted and active for 6 months. After 6 months the ElectroTour can be extended for 6 more months by placing a renew order. There will be a small fee of $19.95 to renew the ElectroTour and re-syndicate it to our syndication partners. This service fee covers the cost of our office staff manually re-posting your listing on the websites we syndicate to. If the tour has been removed from the website and needs to be reloaded and pulled from our archives the fee will $29.95.

Note: If we do not receive a renew order from you before the tour expires the tour may be removed from active status after 6 months. We will keep a copy of the tour in our backup data base archives for 2 additional months. After the 8th month the tour will be deleted from our data base. If at that time you want to extend the tour or reactivate it you will be required to order a new tour.

Note:
If a New Agent Takes Over The Listing / Listing Expires in the MLS before 6 months / Listing is Withdrawn
The ElectroTour will expire immediately. ElectroTours are non transferable.
